1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you and CopyChek ("we," "us," or "our") concerning your access to and use of our website and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the service.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

Our content and materials may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us.

3. User Content and Intellectual Property

Your Content Remains Yours: You retain all intellectual property rights to any content, materials, data, or information that you provide to or input into our Service ("User Content"). This includes but is not limited to:

  • Marketing materials, copy, and content you create using our Service
  • Business information, product descriptions, and brand materials you provide
  • Any text, images, or other content you upload or input into our platform
  • All output, copy, and marketing materials generated by our Service based on your inputs

License to Use: By using our Service, you grant us a limited, non-exclusive, royalty-free license to use your User Content solely for the purpose of providing our Service to you, including processing, analyzing, and generating copy based on your inputs. This license terminates when you delete your content or close your account.

No Ownership Claims: We do not claim any ownership rights over the marketing copy, content, or materials you create using our Service. You are free to use, modify, distribute, and commercialize any content generated through our platform without restriction or attribution to us.

4. User Representations

By using the Service, you represent and warrant that:

  • You have the legal capacity and you agree to comply with these Terms;
  • You are not a minor in the jurisdiction in which you reside;
  • You will not access the Service through automated or non-human means, whether through a bot, script, or otherwise;
  • You will not use the Service for any illegal or unauthorized purpose;
  • Your use of the Service will not violate any applicable law or regulation;
  • You own or have the necessary rights to all User Content you provide to our Service.

5. User Registration

You may be required to register with the Service. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

6. Prohibited Activities

7. Feedback and Suggestions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Service provided by you to us ("Feedback") are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of this Feedback for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

8. Service Management

We reserve the right, but not the obligation, to:

  • Otherwise manage the Service in a manner designed to protect our rights and property and to facilitate the proper functioning of the Service.

9. Data Protection and Privacy

We are committed to protecting your privacy and the confidentiality of your User Content. We will not use your User Content for any purpose other than providing our Service to you, unless you explicitly consent otherwise. Your User Content will not be shared with third parties or used to train our models without your express permission.

10. Term and Termination

These Terms shall remain in full force and effect while you use the Service. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease, but your intellectual property rights to your User Content and generated materials will remain intact.

11. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Service without notice at any time.

We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

12. Governing Law

These Terms shall be governed by and defined following the laws of [Your Country]. CopyChek and yourself irrevocably consent that the courts of [Your Country] shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
